Acceptance of Terms
By accessing or using the DB9 platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Description of Service
DB9 provides a PostgreSQL-compatible database platform built on TiKV. The Service includes database provisioning, SQL execution, filesystem storage (fs9), branching, and associated APIs, SDKs, and CLI tools.
Accounts
You may create an account through the CLI, SDK, or web interface. Anonymous trial accounts are available for evaluation. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You must provide accurate information when creating an account. You may not create accounts for the purpose of abusing the Service, violating these Terms, or impersonating others.
Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Store or transmit malicious code, malware, or content that infringes third-party rights
- Attempt to gain unauthorized access to other users' databases or accounts
- Interfere with or disrupt the Service or its infrastructure
- Circumvent usage limits, quotas, or rate limits
- Use the Service for cryptocurrency mining or similar resource-intensive activities unrelated to database operations
Data Ownership
You retain all rights to the data you store in DB9. We do not claim ownership of your database content. You grant us a limited license to host, store, replicate, and transmit your data solely to provide and maintain the Service.
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.
Storage and Quotas
Database storage and usage are subject to the limits of your plan. Details are described in Storage & Limits and Limits & Quotas. We may enforce quotas to ensure fair use across all tenants.
Payment
Paid plans are billed according to the pricing published on our website. You agree to pay all fees associated with your account. We may change pricing with 30 days' notice. Failure to pay may result in service suspension.
Termination
You may terminate your account at any time by deleting your databases and contacting us. We may suspend or terminate accounts that violate these Terms or remain inactive beyond the retention policy for anonymous accounts.
Upon termination, your data will be deleted according to the retention schedule described in our Privacy Policy.
Limitation of Liability
To the maximum extent permitted by law, DB9 and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless DB9, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
